Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Entrepreneur: FireRocket, established at Gerrit Bolkade 28, 1507BR Zaandam, registered with the Chamber of Commerce under number 98575511;
  • Consumer: the natural person who is not acting in the course of a profession or business and who enters into an agreement with the entrepreneur;
  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal;
  • Right of withdrawal: the consumer's option to withdraw from the distance agreement within the cooling-off period;
  • Day: calendar day.

Article 3 - Applicability

  1. These terms and conditions apply to every offer by the entrepreneur and to every distance agreement concluded between the entrepreneur and the consumer.
  2. Before the agreement is concluded, the text of these terms and conditions is made available to the consumer electronically, in such a way that it can easily be stored.

Article 4 - The offer

  1. If an offer has a limited period of validity or is subject to conditions, this is explicitly stated.
  2. The offer contains a complete and accurate description of the products offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur.

Article 5 - The agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set out therein.
  2. The entrepreneur immediately confirms receipt of the acceptance of the offer electronically.

Article 6 - Right of withdrawal

  1. The consumer may dissolve an agreement relating to the purchase of a product during a cooling-off period of 14 days without giving reasons.
  2. The cooling-off period starts on the day after the consumer, or a third party designated by them, has received the product.
  3. Within the cooling-off period, the consumer notifies us via info@firerocket.nl or the model withdrawal form that they wish to withdraw from the agreement.

Article 7 - Obligations in the event of withdrawal

  1. During the cooling-off period, the consumer handles the product and packaging with care. They only unpack the product to the extent necessary to establish its nature and characteristics.
  2. The consumer returns the product within 14 days of the withdrawal notification.
  3. Returning is free of charge: FireRocket covers the cost of the return shipment and provides you with a return label.

Article 8 - Costs in the event of withdrawal

The entrepreneur refunds the full purchase amount, including any delivery costs, within 14 days of the withdrawal, provided the product has been received back or the consumer has demonstrated that it has been returned.

Article 9 - Exclusion of the right of withdrawal

The right of withdrawal does not apply to products that have been manufactured to the consumer's specifications or are clearly personal in nature, and to products that, after delivery, are by their nature irreversibly mixed.

Article 10 - The price

  1. All prices include VAT, unless stated otherwise.
  2. During the validity period stated in the offer, prices are not increased, except for price changes resulting from changes in VAT rates.

Article 11 - Conformity and warranty

  1. The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer and the statutory provisions.
  2. The warranty stated on the product page and in the manufacturer's warranty terms supplied applies to the pellet stoves. Any manufacturer's warranty does not affect the consumer's statutory rights.

Article 12 - Delivery and execution

  1. The entrepreneur takes the greatest possible care when carrying out orders.
  2. Orders are carried out within the delivery time indicated on the website, with a maximum of 30 days, unless otherwise agreed.
  3. The risk of damage and/or loss of products rests with the entrepreneur up to the moment of delivery.

Article 13 - Payment

Unless otherwise stipulated, the amounts owed by the consumer must be paid at the moment of ordering via the payment methods offered.

Article 14 - Complaints procedure

  1. Complaints about the execution of the agreement must be submitted to the entrepreneur, fully and clearly described, within a reasonable time, via info@firerocket.nl
  2. The entrepreneur answers complaints within a period of 14 days of receipt.

Article 15 - Disputes and applicable law

Dutch law applies exclusively to agreements between the entrepreneur and the consumer.
